Gnomey Terms of Service

Welcome to Gnomey (“Gnomey,” “the Game,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of Gnomey, including the game, online services, websites, features, content, virtual items, purchases, multiplayer functionality, and other services we provide in connection with Gnomey (collectively, the “Services”).

By downloading, accessing, or using Gnomey, you agree to these Terms. If you do not agree to these Terms, do not access or use Gnomey.

If you are under the age required to legally agree to these Terms in your country or region, you may use Gnomey only with the involvement and permission of a parent or legal guardian where required by applicable law.

1. Eligibility

You may use Gnomey only if you are legally permitted to use the Services under the laws applicable to you.

You are responsible for ensuring that your use of Gnomey complies with the laws and regulations applicable to you.

Certain features may have additional age requirements imposed by Meta or applicable law.

We may restrict access to certain features based on age, platform requirements, regional requirements, or other applicable restrictions.

2. Your Account

Gnomey may use third-party services, including platform services provided by Meta and other service providers, to authenticate users, provide multiplayer functionality, process purchases, save game information, and provide other features.

You are responsible for maintaining the security of any account or platform credentials used to access Gnomey.

You must not:

Use another person's account without authorization.
Attempt to access another user's account.
Impersonate another person or entity.
Provide false information for the purpose of bypassing restrictions.
Circumvent account or access restrictions.
Use Gnomey through unauthorized accounts, modified clients, or unauthorized software.

We may suspend or terminate access to Gnomey if we reasonably believe an account is being used in violation of these Terms or applicable law.

3. Multiplayer and Social Features

Gnomey may allow users to meet, communicate, and interact with other users in shared virtual spaces.

Depending on the features available, interactions may include:

Voice communication.
Multiplayer gameplay.
Shared virtual environments.
Player interactions.
Social activities.
Other communication or interaction features introduced in future updates.

You understand that other players may hear or otherwise experience communications or actions that you make while using multiplayer features.

You are responsible for your conduct when interacting with other players.

You must not use Gnomey to:

Harass, threaten, stalk, or intimidate another person.
Engage in hateful or discriminatory conduct.
Make credible threats of violence.
Sexually harass or exploit other users.
Encourage self-harm or violence.
Share another person's private or personal information without permission.
Impersonate another player, developer, moderator, or other person.
Attempt to manipulate or exploit other players.
Use communication features to distribute illegal content.
Intentionally disrupt other players' experiences.

We may take action against accounts that violate these rules, including warnings, temporary restrictions, removal from rooms, suspension, or permanent bans.

4. User Conduct

You agree to use Gnomey responsibly and lawfully.

You may not:

Cheat or exploit bugs for an unfair advantage.
Use unauthorized third-party software, cheats, hacks, bots, scripts, or modifications.
Reverse engineer, decompile, disassemble, or attempt to obtain source code from the Game except where such activity cannot legally be restricted.
Modify the Game or its files in a way that provides an unauthorized advantage.
Interfere with servers, networking systems, or other users.
Attempt to gain unauthorized access to our systems or services.
Exploit vulnerabilities.
Conduct denial-of-service attacks or similar attacks.
Manipulate network traffic for an unfair advantage.
Use automation to interfere with normal gameplay.
Circumvent security or anti-cheat measures.
Exploit glitches to obtain unauthorized virtual items, currency, progression, or other benefits.
Sell, trade, or transfer accounts unless we expressly permit such functionality.
Use Gnomey for fraudulent or illegal activities.

We may investigate suspected violations and take appropriate action.

5. Cheating and Exploitation

Fair gameplay is important to Gnomey.

We may use technical systems, server-side validation, gameplay monitoring, reports, logs, and other methods to identify cheating, exploitation, fraud, or other prohibited activity.

We may remove benefits obtained through cheating or exploitation.

We may also suspend or permanently terminate accounts that engage in serious or repeated cheating.

We do not guarantee that our anti-cheat or security systems will detect every violation.

6. Virtual Items and In-Game Currency

Gnomey may contain virtual items, currencies, cosmetics, equipment, upgrades, or other digital content (“Virtual Items”).

Virtual Items may include items obtained through:

Gameplay.
Events.
Rewards.
In-game systems.
Promotional activities.
Purchases through supported platforms.

Unless applicable law requires otherwise, Virtual Items:

Have no cash value outside Gnomey.
Are not redeemable for real money.
Cannot be exchanged for real-world goods or services.
Are licensed to you rather than sold to you as property.
May not be transferred, sold, or exchanged outside Gnomey.

We may change the availability, characteristics, pricing, balance, or functionality of Virtual Items.

We may remove Virtual Items that were obtained through cheating, fraud, unauthorized transactions, exploits, or other violations.

7. Purchases

Gnomey may offer optional purchases through Meta or other supported platform stores.

Purchases are processed by the applicable platform or payment provider and may be subject to that platform's terms and refund policies.

When you make a purchase, you agree that:

You will provide accurate payment information where required.
You will not use unauthorized payment methods.
You will not attempt to fraudulently reverse or dispute legitimate transactions.
You will not exploit purchase systems or entitlement systems.

Digital purchases may be subject to applicable consumer protection and refund laws.

Where applicable, refunds are handled according to the policies of the platform through which the purchase was made.

8. Consumable Items

Certain purchases may provide consumable digital items.

Consumable items may be automatically granted, consumed, or otherwise processed by the Game according to the purchase system.

You must not attempt to duplicate, manipulate, or repeatedly claim consumable purchases.

9. Game Updates and Changes

Gnomey is an evolving game.

We may modify, update, replace, suspend, or remove features at any time.

Updates may include:

New content.
New spells.
New cosmetics.
New maps.
Balance changes.
Bug fixes.
Security improvements.
Performance improvements.
Changes to Virtual Items.
Changes to multiplayer functionality.
Changes required by platform policies.

Some updates may be required in order to continue using the Services.

10. Availability of the Services

We attempt to keep Gnomey available and functional, but we do not guarantee that the Services will always be available.

The Services may occasionally be unavailable because of:

Maintenance.
Updates.
Server problems.
Network problems.
Platform outages.
Security incidents.
Technical failures.
Circumstances outside our reasonable control.

We may temporarily or permanently discontinue particular features or Services.

11. Third-Party Services

Gnomey may rely on third-party services to provide certain functionality.

These may include platform, networking, authentication, analytics, cloud storage, payment, and other service providers.

For example, Gnomey may use services provided by:

Meta.
Normcore/Normal VR.
PlayFab/Microsoft.
Other service providers used to operate the Game.

Third-party services may have their own terms and privacy policies.

Your use of those services may be subject to their applicable terms.

We are not responsible for services controlled entirely by third parties.

12. Privacy

Your privacy is important to us.

Our collection and use of personal information and other user data is described in our Privacy Policy.

Our Privacy Policy explains what information we collect or process, how we use it, how it may be shared with service providers, and how users may request deletion of applicable information.

You should read the Privacy Policy before using Gnomey.

13. User Content

If Gnomey allows users to submit, transmit, display, or otherwise provide content through the Services (“User Content”), you remain responsible for your User Content.

You must not submit User Content that:

Violates applicable law.
Infringes another person's intellectual property rights.
Contains malicious software.
Contains another person's private information without permission.
Is intended to harass, threaten, or harm another person.
Violates these Terms.

By submitting User Content where the Game requires us to process or display that content to provide the relevant feature, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, display, and process that User Content only as reasonably necessary to operate, provide, maintain, and improve the applicable Services.

We may remove User Content that violates these Terms or applicable law.

14. Intellectual Property

Gnomey and its original content are owned by or licensed to Gnomey VR.

This includes, where applicable:

Game software.
Game code.
Characters.
Names.
Logos.
Artwork.
Models.
Animations.
Audio.
Music.
Visual effects.
Spells.
Game mechanics and presentation.
Websites and promotional materials.

Except for the limited rights expressly granted to you under these Terms, we reserve all rights in Gnomey and its content.

You may not copy, redistribute, sell, license, publicly reproduce, or commercially exploit Gnomey's protected content without permission, except where permitted by applicable law.

15. Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use Gnomey for personal, non-commercial entertainment purposes.

This license does not transfer ownership of Gnomey or any of its intellectual property to you.

You may not sublicense or transfer this license.

16. Copyright Complaints

If you believe that content available through Gnomey infringes your copyright, you may contact us at:

Please include enough information for us to understand the copyrighted work, the allegedly infringing material, and how to contact you.

We may remove content or take other appropriate action where legally required.

17. Enforcement

We may investigate suspected violations of these Terms.

Depending on the circumstances, we may:

Issue a warning.
Remove a player from a multiplayer room.
Restrict communication features.
Remove Virtual Items obtained improperly.
Restrict gameplay functionality.
Temporarily suspend an account.
Permanently ban an account.
Take other reasonable measures necessary to protect the Game and its users.

We may consider the severity, frequency, and circumstances of the conduct when determining appropriate action.

We may also take action where required by law or platform policies.

When contacting support about an enforcement action, please provide your Gnomey/Meta username or other information reasonably necessary for us to identify your account.

We may review appeals at our discretion and where required by applicable law.

19. Account Termination

You may stop using Gnomey at any time.

We may suspend or terminate your access to Gnomey if:

You materially violate these Terms.
You engage in cheating or fraud.
You abuse other users.
You attempt to compromise the security of the Services.
Your use creates a security or legal risk.
We are required to do so by law or a platform provider.
We discontinue the Services.

Termination does not necessarily eliminate obligations that by their nature should continue after termination, including intellectual property provisions, disclaimers, limitations of liability, and dispute provisions.

20. No Warranty

To the maximum extent permitted by applicable law, Gnomey is provided on an “AS IS” and “AS AVAILABLE” basis.

We do not guarantee that:

Gnomey will always be available.
Gnomey will always be error-free.
Bugs will always be fixed.
Multiplayer services will always function without interruption.
The Game will work with every device or configuration.
All content or features will remain available indefinitely.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable law.

21. Limitation of Liability

To the maximum extent permitted by applicable law, Gnomey VR will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of Gnomey.

This may include, where legally permitted, loss of data, loss of profits, loss of virtual items, interruption of service, or other indirect losses.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

22. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Gnomey VR from claims, liabilities, damages, losses, and expenses arising from:

Your violation of these Terms.
Your unlawful use of Gnomey.
Your User Content.
Your violation of another person's rights.
Your misuse of the Services.

This section does not apply to the extent that the claim was caused by our own unlawful conduct or where such an agreement is prohibited by applicable law.

23. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may provide notice through the Game, our website, or another reasonable method.

The updated Terms will become effective on the date stated at the beginning of the updated Terms.

Your continued use of Gnomey after the updated Terms become effective means you accept the updated Terms, to the extent permitted by applicable law.

24. Governing Law

These Terms will be governed by the laws of United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute that cannot be resolved informally will be handled in the courts or dispute-resolution process required or permitted by applicable law.

25. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted by law.

The remaining provisions will continue in effect.

26. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms specifically applicable to particular Gnomey features, constitute the agreement between you and us regarding your use of Gnomey, except where additional terms are expressly provided.
